3.  Records Request in accordance with Iowa Code Chapter 22

A request for records in accordance with Iowa Code Chapter 22 was sent to the City of Ames, IA, and the Ames, IA Police Department requesting law enforcement incident reports this agency has communicated exist.  In conjunction with phoenixharbor.com web traffic logs, these records show evidence of abusive/harassing behavior of end-users originating from Cable One.  Iowa Code 22.7(5) indicates these Iowa Incident Reports are public records.

These records requests have been sent to the Ames, IA Police Department since December 2021.  This harassment (known) originated from Cable One on 23 NOV 2021 at approximately 1819 CST.  As of 25 MAR 2022, the Ames, IA Police Department has failed to provide these records in accordance with Iowa Code Chapter 22.

This delay by the Ames, IA Police Department has prevented the reporting and presentation of consolidated evidence of this behavior to Cable One and State of Iowa law enforcement.  This delay has caused unnecessary expense and wasted resources monitoring this behavior while the Ames, IA Police Department has shown evidence of an unreasonable delay providing these records.

A complaint against the Ames, IA Police Department has been filed with the Iowa Public Information Board in accordance with Iowa Code Chapter 23.  Upon receiving requested records from the Ames, IA Police Department, Cable One will receive a historical timeline of abusive/harassing behavior supported by evidence relating to traffic originating from internet protocol addresses managed by Cable One. This correspondence will include a cease and desist agreement requesting specific internet protocol addresses and their end-users being blocked from accessing intellectual property hosted online published and maintained by 4d69636861656c204a2e204d6572726974740d0a0d0a0d0a0d0a0d0a0d0a at 70686f656e6978686172626f722e636f6d0d0a0d0a.

4. Conclusion

The originator of this correspondence currently has no grievance against Cable One, but there is an expectation of future cooperation regarding the facilitation of healthy traffic from Cable One infrastructure.  Ames, IA Police Department’s delay in adhering to Iowa Code Chapter 22 has caused unnecessary hardship due to their failure to provide a response that reflects the spirit of Iowa Code Chapter 22 as articulated by the Iowa Supreme Court in Horsfield Materials, Inc. v. City of Dyersville, 834 N.W.2d 444 (Iowa 2013).
