As well as communicating this information to the City of Newton, IA Records Clerks so they know what records to release for the fee he is communicating. The attached audio files verify who the Records Clerks are for the City of Newton, IA. The attached audio files are public records received from the City of Newton, IA, contradicting Mr. Brick’s historical testimony regarding the City of Newton, IA, not having a records clerk. The attached electronic mail shows that historically the same city employees have been performing the function of the city’s records clerk since at least 2019.

Provided audio recording from two 20 DEC 2022 phone conversations provides evidence of Mrs. Lamb confirming herself, Mrs. Graff, and Mrs. Montgomery currently handle public records requests for the City of Newton, IA Police Department. However, evidence indicates their professional titles have been changed to Administrative Assistants, as shown in recent electronic mail. Evidence indicates Mrs. Lamb and Mrs. Graff have performed the function as the City of Newton, IA Police Department’s Records Clerk during the time City of Newton, IA Attorney Matthew Brick established the City of Newton, IA no longer has a Records Clerk. All electronic mail attached going back to 2019 was provided by Mr. Brick prior to the mythical 30-day retention period City Attorney Matthew Brick now reports his client’s mail server now utilizes. At the same time, Mr. Brick reports all electronic mail older than 30 days is stored and preserved on local computers and available upon the city being provided an elevated fee for the alleged necessary local desktop searches for requested records. A fee that Mr. Brick did not require for electronic mail provided by multiple users going back to 2019 in his 10 FEB 2022 response.

I am requesting confirmation the IPIB has received my electronic mail communicating that I will pay City Attorney Matthew Brick’s fee to search for public record receipts I have requested he has communicated are stored and preserved on his client’s electronic mail server. IPIB case: 22FC:0071. If City Attorney Matthew Brick is in a position to communicate these financial records documenting public record fee’s previously collected are stored and preserved on an electronic mail server so be it. Time will tell whether this is accurate and whether my provided funds were collected for a proper search for records that evidence indicates are produced, stored, and preserved on the computer located at the Newton, IA Police Department business office front desk.

Mr. Brick I respect the fact your credentials indicate you know how to dot your t’s and cross your eyes in a court of law. At the same time, I find evidence of your information systems record search strategy to be rather intriguing. As a citizen that has spent his entire professional career connecting computers to shore stations thousands of miles away I find myself completely outmatched in this situation.
