Mr. Brick stipulates in his most recent response to the Iowa Public Information Board (attached): “B. City Response: Mr. Merritt alleges in his complaint that date of the open records violation was December 14, 2022. On that day the City submitted the attached response to Mr. Merritt’s records requests (see attached). As clearly stated in that response, there are no records responsive to Mr. Merrit’s requests for body camera footage from Officer Watson’s camera on November 18, 2022, at approximately 2:30 p.m. (See id.) However, the City’s response did notify Mr. Merritt that there was body camera footage available in response to his other request involving Officer Watson that would be provided upon payment of a fee. (See id.)”

Please inform the Iowa Public Information Board (in accordance with your chain of command and local procedure) that this statement is false. We spoke previously regarding this video not being available due to the age of the requested chest cam footage. IOWA OPEN RECORDS REQUEST – CITY OF NEWTON, IA – #019 – CFS-19016725)

Mrs. Johnson: Mr. Brick has lied about the purpose of Iowa Code Section 22.7 while concealing public records that show the Newton, IA Police Department executed inadequate and inconsistent actions compared to another case with a victim of a different gender. Mr. Brick stipulates in Paragraph (F.), “Further, the City has never refused to provide incident reports to Mr. Merritt (see, e.g., City’s February 9, 2023, response to records request). Instead, Mr. Merritt has been notified two things: (1) that he will have to pay for copies of requested incident reports; and (2) pursuant to Iowa Code Section 22.7.5, peace officers’ investigative reports are generally confidential.” It would seem logical that Mr. Brick is also lying about the existence of the 18-NOV 2022 chest cam footage that will reveal Officer Watson communicating he was not involved in the search of my home represented in CFS-19016725, including his name. At the same time, he refused to help me with a criminal report of an organization refusing to give me my money back ($600) while the evidence of their actions indicates a violation of the Iowa Code. Officer Watson’s response was consistent with my historical requests for help to the Newton, IA Police Department documented on incident reports that the City of Newton, IA, did not provide, including my name.

Mr. Brick, if you and the City of Newton, IA “has never refused to provide incident reports” to me, please provide Mrs. Johnson evidence of the 20 plus incident reports you allegedly have provided me in response to my 04 JAN 2022 request. Logic would suggest that if you and the City of Newton, IA have never refused to provide incident reports I should have the Incident Reports the Jasper County, IA Sheriff’s office documents they turned over to the Newton, IA Police Department. Additionally if the City of Newton, IA has contracted you to handle their legal affairs and you have refused to provide Iowa Incident Reports while providing them legal representation that indicates the City of Newton, IA has as well. As you indicated, this request is over one year old, and the Iowa Public Information Board’s jurisdiction stipulates in Iowa Code Chapter 23.7

“1. The board shall adopt rules pursuant to chapter 17A providing for the timing, form, content, and means by which any aggrieved person, any taxpayer to or citizen of this state, the attorney general, or any county attorney may file a complaint with the board alleging a violation of chapter 21 or 22. The complaint must be filed within sixty days from the time the alleged violation occurred or the complainant could have become aware of the violation with reasonable diligence. All complaints filed with the board shall be public records. 2. All board proceedings in response to the filing of a complaint shall be conducted as expeditiously as possible. 2012 Acts, ch 1115, §10, 17”

Your testimony that the City of Newton, IA, “has never refused” to provide Iowa Incident Reports is within the last 60 days. It would seem if you fail to provide evidence supporting this bold statement, it is my belief you have reopened my 04 JAN 2022 request for examination with the Iowa Public Information Board based upon evidence of your lie in this current case to the Iowa Public Information Board while you attempt to stand on water with a Sailor that spent twenty years serving you on it.

Mr. Brick, I am not your adversary. I died in the Des Moines VA Hospital in the Spring of 2019. Your adversary is the Truth and the Light that reveals it. Your enemy is God because evidence indicates you insist on living a life of deceit while you line your pockets with silver coins.

I respectfully submit to you, Mr. Brick, suppose you do not believe in the only God. Then it would help if you accepted your reality that you are being publicly dismantled by an **% disabled veteran treated for multiple health problems by the Department of Veteran Affairs that only has a high school diploma with a C average, no money, no car, and few friends.

I have grown to favor living a life having nothing. Because when we have few distractions in this world, it helps us to see the Kingdom that waits for us in Heaven.

Mrs. Johnson, in the attachment titled “Jasper County, IA Sheriff – Records Response – 25 MAR 2022” I respectfully request you show me the spirit of Iowa Code Chapter 22 and Iowa Code Chapter 23 and demand that City Attorney Brick provides evidence supporting his statement, “Further, the City has never refused to provide incident reports to Mr. Merritt (see, e.g., City’s February 9, 2023, response to records request). Instead, Mr. Merritt has been notified two things: (1) that he will have to pay for copies of requested incident reports; and (2) pursuant to Iowa Code Section 22.7.5, peace officers’ investigative reports are generally confidential.”

John, evidence indicates Sheriff John Halferty has put tape on my mouth and silenced my voice. I want you to know that I have served in chain of commands and I have been given orders I did not agree with. I want you to know my grievance is with the Jasper County, IA Sheriff. I believe in the man I am talking to in this moment.

I lost the ability to be a Dad because of a lie. I have no enemies except those that speak them. Anyone who feels they have let me down or has a reason to believe I have a grievance with you we will get through it together.

The selfish pursue millions in civil court. The selfless pursue Acts that save millions in life. Jesus Christ did not sue the Romans after the Resurrection. He worked to reveal the truth to them.
